Jeremy Ward represented a Defendant sued for allegedly causing a severe vehicle accident. The case was initially filed in Tulsa County District Court, but Plaintiff later dismissed the claim for unspecified reasons. Plaintiff timely re-filed in compliance with Oklahoma’s saving statute; however, Plaintiff failed to timely re-serve the Defendant. Jeremy’s motion to dismiss Plaintiff’s re-filed action based on the untimely service was sustained. The Court’s order dismissed the action without prejudice. The second dismissal however acted as a dismissal with prejudice based on Oklahoma’s civil procedure rules and cannot be re-prosecuted by Plaintiff. The claim is now over. Defendant did not pay anything to Plaintiff.
